VAT General Implementation Communiqué Series 52: report, guarantee and risk rules for refunds
Series 52 implements Law 7524: VAT refunds are decided by inspection report or guarantee, with guarantee multiples for negative findings.
The Revenue Administration’s Communiqué Amending the VAT General Implementation Communiqué (Series No: 52) was published in Official Gazette No. 32708 on 31 October 2024.
Under Article 36 of Law 3065 as amended by Law 7524 of 28 July 2024, refund claims are generally decided on the basis of an inspection report; where a guarantee is provided, the claim can be paid against it. The guarantee is set at 150% of the refund. For taxpayers with negative findings such as fake or misleading invoices, the refund is decided by report or against a guarantee of two to five times the refund amount depending on the finding; normal processing can resume after a set period. The communiqué also regulates refund procedures for port and airport services and for foreign state institutions.
Please refer to the official text for the entry-into-force provisions. Companies tracking export-related VAT refunds may review their refund file and guarantee processes within this framework.
