Customs Regulation amendment: VAT on non-final costs and electronic record keeping
The January 2023 amendment covered import VAT on non-final storage and port costs, electronic retention of declarations and inward processing closure periods.
The Ministry of Trade’s Regulation Amending the Customs Regulation was published in Official Gazette No. 32062 on 3 January 2023.
A new paragraph in Article 53 covers import VAT base elements whose amounts are not yet final, such as storage, unloading and port costs; these are declared with taxes paid by the 26th of the month following the month the cost is booked. Electronic signing and retention of export and warehouse regime declarations is regulated. The closure period is shortened to three months for conditionally exempt inward processing and one month for customs-supervised inward processing. Where undervaluation is suspected, a guarantee is required for the difference between declared and assessed duties.
Articles 2 and 3 took effect on 1 February 2023, Articles 7, 9 and 15 and the new row in Annex 82 60 days after publication, and the other articles on publication. Companies tracking customs declarations, VAT and inward processing closure in SAP may need to adjust their processes.
